TERMS AND CONDITIONS OF USE - AMIGGOAPP USERS

1. OBJECT

These Terms govern the relationship between Whatsmov S.L. and the User regarding the use of the AmiGGoapp application, defining the rights and obligations derived from access to mobility content and services connected to vehicle repair in partner workshops.

2. DESCRIPTION OF SERVICES

AmiGGoapp is an application that offers free or subsidized mobility solutions to the User when they process a repair of their vehicle in an associated workshop. The User can choose between various reward options: replacement vehicle (up to 3 calendar days), Carsharing services, VTC, taxi or vouchers for supermarkets or service stations, the amount of which will vary according to the magnitude of the repair.

Depending on the chosen option, AmiGGoapp will load an amount into the User's virtual wallet to be used in any of the collaborating companies, in divisible vouchers of €15 each. The amounts and conditions will vary according to the type of damage and number of parts repaired. (€30 for a minor repair, €60 for a medium repair and €75 for a major repair. The €75 reward can be exchanged for 3 days of replacement vehicle).

Whatsmov S.L. is not responsible for the services offered by collaborating companies, and the User must accept their particular conditions in each case.

3. LICENSE OF USE

Whatsmov S.L. grants the User a limited, non-exclusive, revocable and non-transferable license for personal use of the application. It is prohibited:

• Copy, modify or distribute the software.
• Use the app for commercial purposes without prior authorization.
• Reverse engineer or decompile the application.
• Share access with unauthorized third parties.

All rights not expressly granted are reserved by Whatsmov S.L.

4. ABSENCE OF WARRANTIES AND LIMITATION OF LIABILITY

The User accepts that they use the app under their sole responsibility. Whatsmov S.L. does not guarantee the continuous availability of the service nor is it responsible for interruptions, errors, or direct or indirect damages caused by third parties, force majeure or misuse by the User.

All liability for loss of data, technical damage, or damages derived from the use of software or interaction with third-party sites or services is excluded.

5. ACCESS AND NAVIGATION

Access to the app requires an internet connection. Whatsmov S.L. does not guarantee that access will be uninterrupted or error-free. The User acknowledges that there may be interruptions due to maintenance, technical improvements or other reasons.

6. COLLECTED INFORMATION

The app collects personal information during registration and use, including: name, phone, email, vehicle documents, policy data, and interaction information on the platform. It may also collect usage data, approximate location, preferences, interests, activity history, consumption and behavioral patterns to personalize the experience and develop commercial profiles.

6.1 DATA RESPONSIBILITY

The User is responsible for the veracity and updating of the information provided. Whatsmov S.L. will not be responsible for errors, unauthorized access or consequences derived from incorrect or malicious use of data by the User or third parties.

7. USE OF INFORMATION AND TRANSFER TO THIRD PARTIES

Whatsmov S.L. may:

• Use data to improve User experience and personalize services.
• Share information with AmiGGoapp group entities (insurers, financial, real estate, technological, mobility and consumption).
• Assign, share or transfer data to collaborating companies and third parties with whom Whatsmov S.L. has commercial agreements or strategic alliances, for Marketing purposes, market studies, promotional communications, analytics or commercial prospecting.

The User expressly authorizes these transfers for commercial purposes and accepts being contacted by electronic, telephone or postal means by companies related to the aforementioned sectors.

This consent is voluntary, revocable at any time, and does not condition access to essential AmiGGoapp services. The User may modify their privacy settings or revoke consent by sending an email to info@amiggoapp.com or from their profile.

8. PRIVACY POLICY

Personal data collected is treated in accordance with the General Data Protection Regulation (GDPR) and Organic Law 3/2018. The User may exercise their rights by written communication to: info@amiggoapp.com.

9. NOTIFICATIONS

The User may receive notifications about the status of their services, offers and promotions via email, SMS or push notifications, which they can configure in the application.

10. LINKS TO THIRD PARTIES

The app may include links to third-party websites or applications. Whatsmov S.L. is not responsible for the content or privacy policies of such sites.

11. INDEMNITY

The User agrees to indemnify and hold harmless Whatsmov S.L. against any claim arising from misuse of the app or breach of these Terms and Conditions.

12. INTELLECTUAL AND INDUSTRIAL PROPERTY

All contents, designs, brands, logos, and source code of AmiGGoapp are the exclusive property of Whatsmov S.L. or have the corresponding license. Its use without authorization is prohibited.

13. CONDITIONS OF USE OF THE APPLICATION

The User undertakes to use the services in a lawful and respectful manner. It is prohibited:

• Introduce malicious software or automate use.
• Collect data from other users.
• Use the app for commercial purposes without permission.
• Alter the operation of the app or its contents.

14. LEGISLATION AND JURISDICTION

This contract shall be governed by Spanish legislation, regardless of the place from which the services are accessed or used.

In the event that the User has the status of consumer and resides outside of Spain, the mandatory consumer protection provisions of their country of residence shall apply only when required by applicable international regulations, without prejudice to the fact that any dispute or conflict shall preferably be submitted to the Courts and Tribunals of Madrid (Spain).

In all other cases (including professional Users, freelancers, companies or individuals without the legal status of consumer), the parties expressly agree to submit to the exclusive jurisdiction of the Courts and Tribunals of Madrid (Spain), waiving any other jurisdiction that may correspond to them.
